Terms & Conditions
Agreement to Terms
By proceeding with any booking, submitting this onboarding form, accepting a quote, or engaging Eternal Media, the client (“you”) agrees to the following Terms & Conditions.
Bookings & Cancellations
Bookings cancelled on the day of the scheduled shoot will incur a cancellation fee equal to 50% of the total booking value.
This fee covers time reserved, scheduling commitments, and operational costs incurred.
If a booking is cancelled on-site and the shoot cannot proceed due to client-related reasons, the full shoot fee may be charged.
Travel Fees
A travel fee of $60 applies to properties located 20–50km from the Brisbane CBD, unless otherwise agreed in writing.
Travel beyond this range may incur additional charges.
Invoicing & Payment Terms
Invoices are issued on the 1st of each calendar month unless otherwise advised in writing.
Payment is due by the 15th of that month unless otherwise agreed in writing.
Late Payments
Invoices not finalised within 15 days of the due date will incur a 10% overdue fee.
A further 5% overdue fee will be applied for every additional 5-day period until payment is received in full.
Eternal Media reserves the right to pause delivery of services or assets where invoices remain unpaid.
Asset Ownership & Licensing
All assets produced by Eternal Media, including but not limited to photography, videography, floor plans, digital media, and marketing materials (“Assets”), remain the property of Eternal Media.
A limited licence is granted for use of the Assets only in connection with the original vendor and property for which they were created.
Use of any Assets for a different vendor, a different property, or a future campaign requires written approval and may incur a re-licensing fee.
Eternal Media reserves the right to use produced Assets for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.
Review & Approval of Assets
All Assets supplied must be reviewed and approved by the client, including both the vendor and agent where applicable, prior to publication or use.
Once approval has been given, or where Assets are used without review, Eternal Media accepts no liability for errors, omissions, or inaccuracies.
Revision requests should be submitted within 7 days of delivery. After this period, the project may be considered complete and further changes may incur additional fees.
Floor Plans
Floor plans are provided for marketing purposes only.
It is the responsibility of the client and vendor to verify all measurements, layouts, and information prior to use. Eternal Media accepts no responsibility or liability for inaccuracies once delivered.
Call Recording
Telephone communications with Eternal Media may be recorded for booking accuracy, quality assurance, training, and internal record-keeping purposes. By engaging our services, you acknowledge and consent to such recordings.
Scheduling & Availability
All bookings are subject to availability. Eternal Media will make reasonable efforts to accommodate preferred dates and times; however, scheduling cannot be guaranteed until confirmed.
Shoot times may be adjusted where required due to weather, lighting conditions, or operational considerations in order to achieve the best possible result.
Delivery of Assets & Timeframes
Estimated delivery timeframes will be outlined in the relevant quote, invoice, or written communication.
While Eternal Media makes every effort to deliver within the estimated timeframe, delivery dates are estimates only and may be affected by weather conditions, access delays, client response times, revision requests, technical issues, or other unforeseen circumstances.
Delivery is deemed complete once files have been uploaded to a shared drive, download link, or delivery platform and notification has been provided to the client.
Additional Services & Scope Changes
Any services requested outside the original agreed scope must be requested in writing and may incur additional charges.
Once additional services or changes have been approved in writing, those charges become binding regardless of whether the client later decides not to proceed.
Client Responsibilities
The client is responsible for ensuring the property or location is ready for filming or photography at the scheduled time. This includes cleaning, decluttering, staging, and ensuring access is arranged.
Eternal Media is not responsible for delays, incomplete coverage, or reduced output caused by areas not being ready, restricted access, weather limitations, third-party interference, or unavailable stakeholders.
Specific inclusions, angles, or requirements should be communicated prior to or during the shoot.
Eternal Media is not obliged to move furniture, personal belongings, or staging items unless agreed in advance.
Editing & Alterations
Clients may not edit, apply filters to, or alter delivered imagery or video without written consent from Eternal Media.
Advertising & Marketing Performance
Where Eternal Media manages advertising or campaigns, we are responsible for strategy, setup, and execution but cannot guarantee specific performance outcomes such as impressions, reach, enquiries, or sales, as these are controlled by third-party platforms and market conditions.
Asset Storage & Retention
Eternal Media takes reasonable steps to protect and store project files; however, long-term archival is not guaranteed.
Clients are responsible for downloading and securely storing all delivered Assets. Retrieval or re-delivery of archived files, where available, may incur a service fee.
Lost or Corrupted Files
In the unlikely event that files are lost or corrupted, Eternal Media will make reasonable efforts to recover them.
If recovery is not possible, a reshoot may be offered where practical. Liability is limited to the value of the services provided.
Force Majeure
Eternal Media is not liable for delays or inability to perform services due to events outside reasonable control, including severe weather, access restrictions, safety concerns, equipment failure, illness, transport disruption, or other unforeseen circumstances.
Liability
To the extent permitted by law, Eternal Media will not be liable for indirect or consequential loss arising from services provided.
Total liability, where applicable, is limited to the amount paid for the services. Nothing in these Terms excludes rights available under Australian Consumer Law.
Governing Law
These Terms are governed by the laws of Queensland, Australia.
Acceptance
By engaging Eternal Media, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
